- Abstract: The existence of an empty regulation on food and drug control by BPOM at the level of the law shows the authority of BPOM in implementing constitutional activism in terms of ensuring the quality and quality of basic needs of citizens, namely drugs and food. This paper aims to describe the legal politics of establishing regional regulations on improving drug and food control as part of the constitutional effort to fill the regulatory space at the law level with regional regulations as a legal umbrella for the implementation of drug and food control in the regions. The approach used in this paper is the statute approach, the case approach, and the conceptual approach, and the analytical technique in extracting legal material is prescriptive analysis. The results of the study found that the regulatory space for drug and food control by BPOM at the level of the law can be filled with the formation of regional regulations, bearing in mind that the problem also faced by BPOM in supervision is a follow-up of the results of supervision by the regions, so that the formation of regional regulations reflects the regional commissioners together with BPOM in the regions to guarantee everyone's right to quality and the quality of the basic needs of citizens which includes medicine and food.
