- ABSTRACT: This commentary considers stakeholder perspectives of Canada's Extractive Sector Transparency Measures Act (ESTMA). In 2015, ESTMA was enacted under Canada's corporate social responsibility (CSR) strategy as a mandatory CSR reporting initiative requiring the financial disclosure of all payments relating to the commercial development of oil, gas, or minerals around the globe. Despite ESTMA's intended purpose to improve transparency and deter corruption within the global extractive sector, little remains known about the acceptance of this mandatory CSR initiative by extractive sector stakeholders. Success of this government initiative likely hinges upon stakeholder acceptance of ESTMA. This study reports the results of a survey of industry stakeholders, including managers, practitioners, and academics, on whether ESTMA positively or negatively affects transparency, financial performance, reputation, decision making, and the ability of firms to do business abroad. Findings indicate stakeholders in Canada believe ESTMA has improved transparency and has had a positive effect on the reputation of Canadian firms in the extractive sector with minimal costs to financial performance, changes to decision making, or effect on ability to conduct business abroad. RÉSUMÉ: Point de vue des parties prenantes du secteur extractif sur la LMTSE Le présent commentaire s'attarde au point de vue des parties prenantes sur la Loi sur les mesures de transparence dans le secteur extractif ( LMTSE ) du Canada. La LMTSE a été adoptée en 2015 dans le cadre de la Stratégie canadienne en matière de responsabilité sociale des entreprises (RSE) à titre d'initiative de communication obligatoire d'information sur la RSE exigeant la divulgation financière de tous les paiements versés par les entreprises en lien avec le développement commercial du pétrole, du gaz naturel ou des minéraux partout dans le monde. Malgré l'objectif de la LMTSE d'accroître la transparence et de prévenir la corruption dans le secteur extractif à l'échelle mondiale, on en sait peu sur l'acceptation de cette initiative obligatoire en matière de RSE par les parties prenantes du secteur extractif, dont l'efficacité repose probablement sur leur acceptation de la LMTSE . Cette étude fait état des résultats d'une enquête menée auprès des parties prenantes du secteur, y compris les gestionnaires, les praticiens et les théoriciens, laquelle cherchait à savoir si la LMTSE influence positivement ou négativement la transparence, le rendement financier, la réputation, le processus décisionnel et la capacité des entreprises à faire des affaires à l'étranger. Les résultats indiquent que les parties prenantes au Canada sont d'avis que la LMTSE a amélioré la transparence et a eu un impact positif sur la réputation des entreprises canadiennes du secteur extractif, tout en limitant au minimum les coûts liés au rendement financier, les modifications au processus décisionnel ou l'effet sur la capacité à faire des affaires à l'étranger. Inscrits dans un contexte canadien, les résultats fournissent d'importantes observations à diverses parties prenantes, dont les organismes de réglementation et les praticiens, pour les aider à mieux comprendre les effets des initiatives de communication obligatoire d'information sur la RSE ainsi que le recours aux divulgations financières obligatoires en tant que mécanisme aux fins de la RSE. … (more)
