- Abstract: The rapid marine economic development in China results in high demand of oceanic and coastal spaces. To allocate and manage these oceanic and coastal spaces more equitably and efficiently, one of the management measures China has implemented is a systematic approach. This approach is based on the market principle (i.e., it is a market-based system) for the sea-use right (SUR) and promulgates the "Law of the People's Republic of China on the Administration of the Use of the Sea Areas" (hereinafter referred to as the Law). By analyzing the market-based condition of the SUR from 2005 to 2017 for China, this paper summarizes the lessons learnt and experiences obtained in the implementation of the Law, and outlines current problems and challenges in the implementation of this approach. Recommendations are provided to better reflect the current requirements for the enforcement of the Law, to set up a better market-based assessment system for SUR, to establish a related market-based service platform, and to strengthen both the supervision and enforcement of relevant market behaviors. The proposed harmonization will: (i) promote efficient and reasonable distribution and allocation of SUR, (ii) stimulate rational and sustainable use of oceanic and coastal spatial resources, (iii) accelerate the optimization and upgrading of the marine industrial structure so that it can meet the requirements of sustainable development, and (iv) improve the quality of the sustainableAbstract: The rapid marine economic development in China results in high demand of oceanic and coastal spaces.
