Abstract

Abstract : Hub and spoke (or 'A to B to C') infringements arise where anti-competitive behaviour between two competitors or 'spokes' (A and C) is co-ordinated or facilitated by a third party 'hub' (B) which typically acts at a different level of the supply chain. This article considers the legal tests that are applicable in establishing an infringement of the Chapter I prohibition of the Competition Act 1998 and the evidence that may be relied on by the Competition and Markets Authority in doing so.
