Abstract

ABSTRACT: On 1 January 2014, the Defamation Act 2013 came into force, introducing in its section 1 a new requirement of serious harm. This paper offers a critique of the serious harm requirement as it has developed in the case law, in light of the objectives that were set for section 1 in the Defamation Bill.
